1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Lindsey O’Connor, doing business as Sunlight and Sagebrush (“we,” “us,” or “our”), concerning your access to and use of the https://www.sunlightandsagebrush.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.

As a creator of original educational and lifestyle content regarding herbalism and flower essences, Lindsey O’Connor retains all rights to the written materials, blog posts, and resources shared on this Site and linked platforms like Substack. The Content and Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms and Conditions, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

3. SERVICES AND EDUCATIONAL SCOPE

Sunlight and Sagebrush provides holistic and educational services focused on flower essence therapy, herbalism, and personal growth.

A. Nature of Services: Our offerings include:

• One-on-one flower essence consultations (Introductory calls, initial sessions, and follow-ups).

• Educational content and informational resources related to holistic health and natural living.

• Customized flower essence remedies designed to support emotional, mental, energetic, and spiritual well-being.

B. Not Medical Advice: You acknowledge and agree that the services and information provided are complementary and educational in nature. The information shared by Sunlight and Sagebrush is not medical advice and is not intended to diagnose, treat, cure, or prevent any medical or psychological condition. Always consult with your physician or qualified healthcare provider before using herbs, herbal medicines, or essential oils, especially if you are pregnant, nursing, or managing a medical condition.

4. USER REPRESENTATIONS

By using the Site, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete.

2. You have the legal capacity and you agree to comply with these Terms and Conditions.

3. You are not a minor in the jurisdiction in which you reside (generally 18 years of age or older).

4. You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.

5. Your use of the Site will not violate any applicable law or regulation.

5. BOOKINGS, PAYMENTS, AND THIRD-PARTY PLATFORMS

Sunlight and Sagebrush uses third-party platforms to operate its services:

  • Practice Better: Client scheduling and service delivery

  • Stripe: Secure payment processing (we do not store financial data)

  • Fullscript: Product recommendations, which may generate commissions

  • External Storefronts: Future product sales via Etsy and Printify. These platforms independently handle payments, shipping, returns, and applicable taxes. Sunlight and Sagebrush does not sell physical products directly on the Site.

6. CANCELLATION AND REFUND POLICY

Appointments booked through Practice Better must be cancelled or rescheduled within 24 hours of the scheduled session time. Failure to provide adequate notice may result in a cancellation fee or forfeiture of the session fee. Refunds for customized flower essence remedies are generally not provided once the remedy has been formulated and shipped, given the personalized nature of the product.

7. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Site, you agree not to:

• Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

• Circumvent, disable, or otherwise interfere with security-related features of the Site.

• Engage in unauthorized framing of or linking to the Site.

• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information.

• Use the Site in a manner inconsistent with any applicable laws or regulations.

8. SITE MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms and Conditions; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions; and (3) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

9. GOVERNING LAW

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the State of California. As Lindsey O’Connor operates as a sole proprietor in San Diego, any legal action or proceeding related to this Site shall be brought exclusively in the courts located in San Diego County, California.

10. LIMITATION OF LIABILITY

In no event will we or our employees be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or services, even if we have been advised of the possibility of such damages.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Sunlight and Sagebrush, Lindsey O’Connor, and our respective officers, agents, partners, and contractors from and against any and all losses, damages, liabilities, claims, demands, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (1) your access to or use of the Site; (2) your breach of these Terms and Conditions; or (3) your violation of any law or the rights of a third party, including, without limitation, intellectual property rights.

12. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.
